1.1 This On Line Shop is owned and operated by Start Technology Limited (registered number 4109452) whose registered office is at Emstrey House North, Shrewsbury Business Park, Shrewsbury, Shropshire, SY2 6LG ("we/us/our"). 1.2 We permit access to and use of the Start Technology Ltd On Line Shop on our web site "http://www.start-shop.co.uk ("the On Line Shop") subject to the following terms and conditions ("the Conditions").
1.3 In these Conditions:
1.3.1 any person or party placing an order with us through the On Line Shop is called "the Purchaser/you/your".
1.3.2 "our web site" means www.start-shop.co.uk
1.3.3 "nominated email address" means the email address confirmed by you in your order.
1.4 No contract exists between you and us until we have received and accepted your order which is submitted to us via the contact form on our web site. We will confirm acceptance of order by email sent to your nominated email address, unless you pay by Paypal, in which case you will receive an email from them confirming the goods ordered. Your use of the On Line Shop, including the placing of orders, will serve as confirmation to us that you have accepted the Conditions.
1.5 We may change these Conditions without notice to the Purchaser in relation to future sales.
2. Sale and Purchase
2.1 The Description and Price of items shall be as shown in the On Line Shop at the time you place your order.
2.2 Items ordered are subject to availability. If on our receipt of your order any or all the items are not in stock and/or not available, we will either create a back order or terminate the contract. If we create a back order, you may cancel the order provided we receive confirmation before the items ordered are dispatched by us to you. If we terminate, we will confirm this to you by email sent to your nominated email address and we will make arrangements with you to return any money paid by you to us.
2.3 Every effort is made to ensure that prices shown in the On Line Shop are correct. If an error is found by us within 14 days of our accepting your order, we will inform you as soon as possible and you may then decide to either cancel the order (in which case we require the return of the items ordered in before we return any money paid by you to us) or re-confirm at the correct price.
2.4 Where any order is validly cancelled within these terms and conditions, we shall refund any sum you may have paid in respect of that order.
2.5 In addition to the item price, delivery charges may apply. The amount of these charges may vary depending on the items ordered, but will normally be £6 +VAT. We will advise you if our charge differs from this standard fee and we will explain why. Please contact us if you require further details before placing an order.
3. Payment
3.1 Payment in full shall be made at the time the order is placed, unless we confirm otherwise.
3.2 Items ordered will not be shipped by us until cleared funds are received by us for the full amount in relation to your order.
3.3 If payment is not made in accordance with these Conditions, we will cancel your order.
4. Delivery
4.1 The items you order will be delivered to the address you provide when you place the order. Please note that delivery can only be made to addresses in the UK mainland, unless we agree otherwise.
4.2 If delivery cannot be made to the address provided, we will inform you as soon as we are able. We will then make alternative arrangements with you for delivery. Extra delivery charges may apply. Please see clause 2.5 above.
4.3 Every effort will be made to despatch available items on the date ordered, if ordered before 3.00 pm, but this is not guaranteed. If we cannot despatch items on the day you order them, we will give you an indication of an estimated delivery/despatch date in our email confirming your order. Time will not be of the essence in relation to your order. We will not be liable for any loss or damage suffered by you through delay in delivery for whatever reason.
4.4 Products may go out of stock or become unavailable at short notice; this will not necessarily be shown on the product details on this website. If an order contains items with different despatch times, the order will normally be despatched when all items are ready for despatch, unless one or more items are out of stock in which case those which are available will be despatched immediately.
5. Your Right to Cancel/Refunds and Returns
5.1 Provided you keep the goods in "as new" condition (and for example in the case of software supplied this means that the shrink wrapping cover and security tag remain intact), you are entitled to withdraw from this contract without stating any reason within seven days of delivery. You must communicate your withdrawal to us within that seven day period. We reserve the right to seek repayment of the costs of delivery where goods are returned by you in this way.
5.2 A full refund will be made if any item fails to be despatched, is lost in the post or if it arrives in a damaged or unusable state. You may, at your discretion, choose to accept a replacement item provided that stocks are available. Claims for non-delivery or damage must be made in writing (email or post). Goods will not be considered undelivered until 28 days have elapsed after posting.
5.3 To return an item for a refund or replacement, please package it securely and send it to [address details]. Please include the original despatch slip (or a copy of it) and a note explaining the reason for the return. Please also state whether you require a refund or a replacement item. If you are returning goods because they are faulty, it helps us if you can include brief details of the fault. You will be responsible for the full costs of returning the item, unless we delivered the item in error. For your own protection, we recommend that you use a recorded-delivery service. If we have delivered an item in error, please contact us by phone ([number]) or email ([email address]) before returning it. We may not require lower value items to be returned, or we may arrange collection by the carrier of our choice. If we do ask you to return it, we will arrange for you to be refunded the postage costs.
5.4 On delivery of your order via courier, you will be asked to sign for the goods received in good condition. Please check the document you sign against the goods received. If the package does not appear to be in good condition, please refuse the delivery. If you are unable to check the contents of the package, please endorse as "Unchecked" when signing the receipt.
